This Photography competition (the ‘Competition’) is subject to the following Terms and Conditions (‘Conditions’) and by entering the Competition you agree to be bound by them. 1. By entering the competition, you warrant to City Hive that all information submitted by you regarding yourself and your competition entry (‘Entry’) is true and accurate and complete in every respect. City Hive reserves the right to verify any information provided in connection with your Entry. 2. All Entries must be received by 09:00 (BST) on 19th December 2022 (closing on 31st January 2023).
3. The Competition is open to persons who are resident in the United Kingdom, and also to persons who are resident outside of the United Kingdom provided that they able to enter the Competition without breaching any law or regulation of the jurisdiction in which they are resident. 4. City Hive shall be entitled to assume that the parents or guardians of any entrant who is less than 18 years old have consented to that person’s entry into the Competition. Entrants may be required to provide proof of identity and if aged under 18, should be able to demonstrate to City Hive’s satisfaction that their parent or guardian has given their consent to such entry. 5. City Hive reserves the right in its absolute discretion to disqualify any entrant if it believes that an entrant has breached any of the Conditions, any applicable law (including without limitation copyright law) or has infringed the intellectual property of any other person. Each entrant acknowledges and agrees that any failure to comply with the Conditions may lead to City Hive disqualifying that person, without City Hive being required to give any reason for such disqualification or granting any opportunity for challenge. 6. Employees of City Hive, their relatives or any agents or employees are not eligible to enter the Competition. Competition entries
7. Entries should be submitted in a HIGH RESOLUTION format, minimum 350 dpi. Images which are not high resolution may be discounted from the competition. Entries should be submitted by the Closing Date on 31st January 2023 and in the manner set out in these conditions. Failure to do so may result in disqualification. Prize-winners
8. Prize-winners will be selected and notified by 1st March 2023 at the latest, by email. 10 winning images and 20 runner up images will be selected by the City Hive judges. All 10 winners will be invited by City Hive to open an account on The Big Exchange and have £100 transferred to them within this account. 20 Runners-up will be invited to open an account on The Big Exchange and have £10 transferred to them within this account. All images entered will be submitted to unsplash.com image library for free commercial use. 9. Those who are determined winners (‘Competition Winners’) will be invited to receive the ‘Competition Prize’.10. Competition Winners will be invited to open a The Big Exchange account of their choosing (there is no upfront cash requirement when opening an account with a regular payment) to receive the Competition Prize into their account within 10 working days of the account being opened subject to meeting the The Big Exchange Platform Terms and Conditions. If the Competition Winner is already a The Big Exchange customer, we will transfer the Competition prize into the Competition Winner’s existing account.11. Tax rules apply and any contributions into ISA or JISA will be subject to annual allowances and limits. Any contribution will be defined as an individual contribution and will count towards your annual allowances. If you have already reached your ISA or JISA limit for the tax year you can open a GIA.12. If you have already opened and contributed to a Stocks and Shares ISA or JISA this tax year, you may not open one with a different provider until next tax year. In this case, you can open a GIA or complete a full account transfer.13. Customers will need to meet the Eligibility Requirements for the account within The Big Exchange Platform Customer Terms and Conditions before opening an account and before receiving the Competition Prize. All new customers need to meet our Know Your Customer identity checks. You will not receive any funds until you have completed these checks. Customers must be UK residents for tax purposes and not a U.S. person.14. Customers will receive the award in cash in your Big Exchange account upon successfully opening the account. 15. These competitions Terms should be read together with our The Big Exchange Platform Customer Terms and Conditions (‘Terms and Conditions’). 16. The definitions contained in our Terms and Conditions shall apply equally to these Terms.17. Tax treatment is the responsibility of each customer. This will depend on the individual circumstances of each customer and may be subject to change in the future. 18. The Competition Prize does not constitute advice. The Competition Prize and it can be declined. 19. When investing your capital is at risk meaning you could end up with less than what you put in. If you are unsure of investing you should seek professional financial advice.20. We do not provide tax advice. Tax treatment on the Competition Prize and on investments are dependent on individual circumstances and these are subject to change. 21. City Hive accepts no responsibility for Entries lost, damaged or delayed whether due to transmission errors, website malfunction, computer error or otherwise. Intellectual property rights and data protection. 22. Entrants agree to their winning pictures appearing on unsplash.com and being available for commercial use for free by any person or organisation using this image library website as well as on ours and our respective partners’ websites and social media. 23. By submitting an Entry in the Competition you grant to City Hive a non-exclusive royalty-free worldwide commercial licence unlimited in time, to use the Entry (whether or not it wins the Competition) in all formats and in any medium of communication, and for all promotional purposes which City Hive shall consider appropriate. You represent and warrant to City Hive, with the intention that City Hive shall rely on such representation and warranty, that each of your Entries is original, and that you own each of them exclusively and have the right, without the permission of any other person or legal entity, to license to City Hive the rights in the Entry for all the purposes contemplated in these Conditions. The scope of the licence granted to City Hive in this paragraph 12 shall include your irrevocable permission to City Hive to use, reproduce, publish, display, transmit, copy, amend, store your Entry worldwide for such purposes as City Hive shall think fit without restriction. 24. Any personal information relating to entrants will be used by City Hive in accordance with data protection legislation in force in England. 25. All Competition entrants unconditionally agree to the use of their name, and disclosure of their county of residence in connection with any Entry which is published in any form in any media. Governing law and jurisdiction
26. These Conditions and any dispute or claim arising out of or in connection with them or their subject matter (including the Competition), validity, termination or enforceability (including non-contractual disputes or claims) shall be governed by and construed in accordance with English law. 27. The Courts of England shall have exclusive jurisdiction in relation to any dispute or claim arising out of or in connection with the Conditions or their subject matter (including non-contractual disputes or claims).
